Deepwater Horizon BP Oil Settlement

Simply put, the Deepwater Horizon BP Oil Settlement Program allows businesses adversely affected by the Deepwater Horizon oil spill to pursue financial compensation for their economic losses. The settlement pack is valued at $7.8 billion. However, there is no actual limit to the amount of financial compensation that may be paid under the settlement. Generally speaking, almost any individual or business located in the Florida Gulf Coast may pursue compensation. This includes all of the panhandle and some counties in Alabama, Mississippi, Louisiana and Texas.

A select few types of business do not quality for compensation including some financial institutions, casinos, gaming businesses, insurance companies, investment funds, financial vehicles, defense contractors, government entities and any institution or entity selling or marketing BP fuel. Real estate developers are excluded, too.

BP Claims and the Oil Pollution Act of 1990

According to public records, $7,148,858,152 had been paid to individuals and businesses for Gulf of Mexico oil spills as of September 30th, 2012. As of June 4th, 2012, the BP Claims Program accepts claims under the Oil Pollution Act of 1990, which allows businesses and individuals to file for financial, economic and property losses tied to the Deepwater Horizon accident. According to BP, claims will fall into one of two categories to qualify for compensation. The individual or business will be a class member (according to MDL No. 2179 Economic and Property Damage Class Action Settlement Agreement) or a non-member.
