How do wrongful death claims work?
Florida's wrongful death act is found in § 768.16. In Florida, survivors of the decedent can bring a wrongful death action against the wrongdoer. "Survivors" include:
- The spouse
- Children (under the age of 25)
- Other blood relatives
- Adoptive siblings
Whoever brings the wrongful death action can pursue compensation in the form of support, services, and net accumulations – this includes lost income, funeral expenses, lost household tasks, and lost pension benefits.
How long do I have to file?
The statute of limitations for most wrongful death actions is two years from the date of the death, but this varies from case to case. To learn how much time you have to file a wrongful death action, contact our firm for a consultation.
