Property Damage - Nine Months is Too Long

One aspect that most car accident victims are concerned with is repairing the property damage to their automobiles. While getting medical treatment for their personal injury is often first in the list concerns of the accident victim, repairing their car is usually second. In Barreau v. Peachtree Casualty Insurance Company, 79 So.3d 843 (Fla. 5th DCA 2012), the court held that nine months was too long to have to wait to have the insurance company pay for the property damage to the plaintiff's vehicle. The court additionally awarded attorney's fees attributable to the insurance company's delay.
