Some clients who come in for consultations are confused as to what a “No Fault” divorce is. “Someone must be at fault is there is a divorce?” Is an oft made statement. Laws granting divorce have evolved over time. It used to be that you could only get a divorce under extreme legal conditions: adultery or abandonment, for example.
At first glance, it would seem to be a good thing; making a divorce difficult to obtain. However, it led to many problems for women trapped in an abusive relationship without the ability for the courts to give them support and marital assets. Over time the legislature in Florida enacted the “No Fault Divorce Law” where you did not need a reason for dissolution of marriage.
