Temporary ban on new PIP law remains in place

According to a recent Miami Herald article, Leon County Judge Terry Lewis, upheld a temporary ban on Florida's new Personal Injury Protection (PIP) law. Judge Lewis approved this ban last month after a lawsuit brought by chirpractors, massage therapists and acupuncturists questioned the legality of the new law. Governor Rick Scott appealed the decision, and in doing so, the ban was placed on hold.
Judge Lewis agreeed to vacate the stay on the ban after ruling that there is potential harm to those injured in car accidents if the new law were to remain in place. Judge Lewis found that the new PIP law likely violated the parts of the Florida constitution that provides access to the courts.
