Were You Injured Working Offshore?

Maritime law, also known as admiralty law, governs incidents and the conduct of vessels that occur out at sea, as well as on any waters traversable throughout the United States for foreign or interstate commerce, including on recreational vessels. United States admiralty law have their roots in British admiralty courts that existed throughout the original American colonies, and while these laws are now under the jurisdiction of federal district courts and shares many similarities with civil law, they are still unique. What Is The Jones Act?

The Jones act is part of The Merchant Marine Act of 1920, which was enacted in order to promote and maintain American merchant marines. This federal statute requires all goods carried between United States ports by water to be transported on ships sporting the U.S. flag that were constructed in the U.S., owned by citizens of the U.S., and have crews who are either permanent residents or citizens. Because maritime work comes with its own unique dangers, in a unique location, and often involves potentially dangerous equipment, this law was put in place to ensure that United States seamen who suffers an illness or injury due to negligence or unseaworthiness receives the legal protection they require, and can secure the compensation due to them.

While Jones Act claims and workers’ compensation claims are typically filed for similar reasons, Jones Act settlements tend to involve larger dollar amounts, in part due to the numerous types of recovery available, including:

  • Cost of living during recovery
  • Loss of future earning capacity
  • Lost wages
  • Medical care
  • Mental anguish
  • Physical pain, disfigurement, and suffering
